RULE MAKING PROJECT: Revision of COMAR 10.43.01 et seq (Chiropractic & Massage Regulations)
The Board of Examiners Regulations Subcommittee has been engaged in a lengthy review project regarding its chiropractic and massage regulations; 3 public meetings were held (advertised online and in MD Register). The Subcommittee has arrived at an initial draft; major substantive revisions include liberalizing CEU course submission/review requirements for both chiropractic and massage therapy, and defining record keeping requirements for massage therapists. This first draft will be reviewed by the Board at the May 9th General Session Meeting. Upon approval, any final revisions will be made and final review and vote will be taken at a June 20th General Session Meeting, Room 100, 4201 Patterson Ave., Balt., MD. Upon final approval, the rule making proposal must be submitted to DHMH for review and will subsequently be printed in the MD Register for general public comments in accordance with DHMH guidelines.
Status/Update: Proposed Rulemaking Project 10.43 et seq.
After a lengthy review by the Legislative AELR Committee, the rulemaking project that encompasses COMAR 10.43 et seq (chiropractors, Chiropractic Assistants, and Massage Therapists) was released for promulgation by DHMH and the State of Maryland. The DHMH Secretary signed the final action on May 16th. It is anticipated that the final action will be printed in the June 3rd edition of the Maryland Register with a June 13, 2011 effective date.
The original proposed revisions to Chapters 16 and 20 (respectively: Massage Recordkeeping and Continuing Education) were withdrawn from the final action and may be revisited at a later date by the Board and a designated subcommittee. The Board also withdrew the proposed revision to Chapter .02 regarding Rules of Procedure for Board Hearings.
The Board will summarize all changes for all licensees and registrants in an upcoming newsletter. If/when the Board determines to revisit the withdrawn chapters, its regulations subcommittee plans on drawing on information and input from affected licensees and registrants via their professional associations. Any General Meetings or Open Hearings regarding any future proposals or revisions will be published in the Maryland Register and on the homepage of the Board Website.
REVISIONS TO COMAR 10.43. et seq
On May 16, 2011, the DHMH Secretary approved the Board revisions to the regulations affecting chiropractors, CAs and Massage Therapists. The revised proposal was published in the June 3rd MD Register; the revisions become effective June 13, 2011.
